Does my father has a right on my grandfather's property

01-Mar-2023 (In Family Law)
My father used to work in a textile firm with his brother and father and we used to live in the same home that firm and home was built by my great grandfather and when he died his only child i.e, my grandfather started working like him but 4 yrs ago my mother started her own buisness by money she owned by her service work and my father started helping her with that and for that we had to leave that house. Now my grandfather died and the brother of my father has taken over whole the property that my grandfather willed it after him. So do we have any right on that property?

You have absolute equal share in the property you said in question. It comes under the ansctrl property and according to the hindu law of land you are entitled to equal share. I mean to say if your grand father has 2 sons it will be equally divided between 2 sons thats i half of the share.
You can file suit for partition to get your shar back. If you like my answer kindly rate me.

Yes, you have the right. You can file a case for separate possession by way of partition. While filing the case you have to give all the details regarding the property which was built by your great grandfather which is a joint Hindu family property. So, you have the right being the Class 1 legal heir.
