23-Oct-2023 (In Family Law)
My husband has filed for Divorce on cruelty in JAN2020.No hearing till date due to covid situation.I dont want divorce. They forced me to leave house.I went out thinking he will get some space to think. But after 5 months no change.I filed DV case against him & in -laws.Now he is ready to give chance to marraige only after I withdraw DV case but he is not ready to withdraw his divorce case.So wanted to know is there any way in legal terms that we both will withdraw the case & after 5-6 months if he dont feel like continue he can continue his present divorce case.I really dont want divorce. Can he put stay on divorce case for sometime.Or any other option.
Yes a settlement agreement can be set out through mediation whereby both the parties will assent to withdraw the case and can also cohabit like before depending the best the mediation is. after knowing the full facts and circumstances of the case it would be recommended to take proper legal assistance.
Yes, you can move an appropriate application before the mediation cell or in the ongoing litigations for referring the matter to mediation wherein you can settle mutually and execute the terms and get it recorded.
file a case for restitution of conjugal rights. also when you withdraw your dv case, make the court record your husband's submission that he wants to give his marriage a chance and reserve your rights to file the dv case in case your husband backs out.
