Does a marriage not registered require legal divorce to remarry

I want to marry a married lady whose marriage happened just befor 1.5 month. She is not able to adjust with those family . Her marriage happened in a ritual way. Can i marry her by court marriage, or she have to take divorce by legal method from her husband. She also want to marry me , we love each other so much since before her marriage. We want to spend our life with each other. We are hindu and are from same cast and same religion.

She has to divorce the earlier husband prior to occasioning fresh marriage. In law once a marriage, it has to be divorced and only then new marriage is possible. there is possibility that it might be difficult

As the lady is already married to a guy in a ritual way or egistered,as per hindu marriage act, she will haveto take divorce from her husband then only u can marry her . And as u said her marriage was solemnised just 1.5 months earlier ,she cannot take divorce at this time, she will have to wait atleast for six months, otherwise before six months, court will not consider their divorce decision. One option is there she may live apart from her husband for some months then file a divorce petition in family court. Aftr that u can marry without any risk...

DEAR SIR IF YOU WANT TO MARRY WITH THAT GIRL THEN FIRST SHE IS REQUIRED TO TAKE DIVORCE FROM HER HUSBAND FIRST. THEN AFTET DIVORCE YOU CAN MARRY HER AND ONCE ANY ONE IS MARRIED THEN UNDER DUE PROCESSES OF LAW SEPERATION CAN BE VALID
