Do i need to attach divorce decree while applying for 2nd marriage?
05-Jun-2025 (In Family Law)
If i decide to get married again do i need to attach divorce decree in that? Or can i still proceed to apply my second marriage as fresh? My first has been dissolved fully and i have all the documents in place but while applying for 2nd marriage i dont want to use that certificate.
When applying for a second marriage in India, it's generally advisable to disclose previous marriages and provide relevant documentation. Here's what you should consider:
- *Legal requirement*: Under the Hindu Marriage Act, 1955, and other personal laws, you're required to declare your marital status and provide documentation, including divorce decrees if applicable.
- *Marriage registration*: When registering your second marriage, you may be asked to provide information about previous marriages. Providing false information can lead to complications.
*Options*:
- *Attach divorce decree*: Attaching the divorce decree can help establish your marital status and avoid potential issues.
- *Fresh application*: If you choose not to attach the divorce decree, you might need to provide an explanation or supporting documentation to verify your marital status.
*Consult a lawyer*: To ensure a smooth process, consider consulting a lawyer specializing in family law or matrimonial disputes. They can guide you on the specific requirements and documentation needed for your second marriage.
By seeking professional advice, you can navigate the process efficiently and avoid potential complications.
