Divorce query on parentssssssssssssssssssssssssssssssssssssssss

My mother and father are living separately for about 20 years now. Whereabouts of my father are unknown. I’m looking for information on legal separation or divorce to be executed for my mother. Can someone advice on the legal outcomes?

two years of non existence or no contact is a ground for divorce. you can file a HMOP petition at your local district court or family court under desertion. Sec. 13(1)(ib) Hindu Marriage Act. The petitioner has a burden of proving and has to prove it beyond reasonable doubt to use desertion as a ground.

since your father's whereabouts are unknown to your mother she can file divorce on dessersion ground if the husband left the wife for 7 Years then she can file for divorce and get Fron the competent court

yes with reference to your query at law rato request you can file a petition for judicial separation on ground desseeted because as per your statement is understood that he is absconded for more than twenty years .hope I clarified the position
