We are Hindu and are 3 sibling: 2 sister and 1 youngest brother. My father die in year 2009. My sister married with her choice boy (Intercaste) against the willing of my Mother & family. Now she and her family are threatened my mother and asking for her share in property. My mother doesnot wants to give any share to her. Please provide us legal advice on the matter.
Yes she can claim in her parents property..bt she should for take no objection certificate.she has right to take equal share in property.mother depends what she think whether she give or not.if yes than u should contact to us.
As per law of the land as also in view of recent Supreme Court's decision, you can not prevent your sister to claim share in her father's property. However, you can linger it. Contact a good lawyer. He will advice you in proper way
Your sister has equal share as you have in your fathers property.... If he (father) died intestate.. She has every right to seek partition because now she has become co partioner. It would be better to settle it out of court if she gets ready to take lesser share.. Get a deet of partition prepared among all co sharers
