I am totally looking after my child who is growing up and have admitted in a elite schoolI along with my ex bought an apartment ..I paid 50% of the cost upfront and loan .. but he is occupying it with his parentsnnIn the court he keeps delaying tactics and covid happened, judges changed tonnIn the mediation, I came down to lowest possible but he agrees for nothing and I am sufferingQUESTION - As case will drag on for more years, I am in need of finance...can I sell my part of the property to third party? What are technicalitiesnnKindly answer/help

You can always file a complaint against your husband under section 125 CrPC and claim your monthly maintenance or the lump sum alimony. And if the property is in your name then you are at full liberty to sell it to anyone you know or like. For more legal assistance I am just a call away.

Hi..!!! If the sale deed is partly in your name and there is no stay on the property then you can sell the property easily. So the technicalities are firstly check the sale deed and secondly your husband if gets to know that you are planning to sell the property may move for injunction so you have to do this quietly. Just wanted to inquire are you not claiming the maintenance from your husband ?
