Can wife claim property rights purchased by in laws over her children?

05-Jul-2023 (In Family Law)
My father in law & Mother in law both are died. He has four sons & two daughters. Three of his sons (one is my husband) have been died.Only one son and two daughters are alive. I am a widow and my age is 60 years. I have three sons & one daughter. My two sons and one daughter are married and one son is unmarried. My father in law had purchased a house where I am residing with my three sons. My father in law had made the 'vasiatnama' in my favour and the same was registered in the court of magistrate. Now my sons dont care about me and even don't give any financial help to me. I have not any source of income as my husband was a businessman. Kindly guide me that does my sons have the right in the property of grand father or not. Can I ask them to vacate the house. Please guide me what should I do.

U can file case under senior citizens and maintenance of Parents Act before SDM court of ur area to get evicted ur son from ur house and to get maintenance from him. Moreover ur son can not get share in ur property, which u got through Will from ur father in law.

if the will of your father in law was in your name then your son's have no right in the property. the house being self acquired property of your father in law and not ancestral property gives no right to your son's in the property. as the will is in your name you are the sole owner of the house. you can ask your son's to vacate the house as they have no legal right over it.
