Can police force me to live with my wife?

13-Oct-2023 (In Family Law)
After my marriage I came to know that my wife was already married to someone else and not legally separated from him. I filed 420 case against my wife for cheating me. She is still living with us and not leaving our house and forcing me to withdraw my case. To threaten me she has file complaint of domestic violence against me in local police and local lady police is forcing me to live with her and not allowing me to move her out of my house. Do police have rights to force me to live with her? My wife is threatening me to charge under false allegations like dowry, domestic violence. She is also visiting some lady who works for women rights. We are totally helpless. Please advise.

Hello sir, If your marriage is not consummated file a petition for cancellation of marriage as it is null n void. Pursue you cheating case and try to take statement from her ex-husband and produce in the court File another police complaint stating the acts of your wife And if you apprehend dowry case take anticipatory bail

Before i respond to this i would like to know if you have any valid proof of her earlier marriage, if yes then you have to file the proceedings for divorce to declare your marriage as null and void... Further you can file a private criminal complaint before the Magistrate court under the provisions of Indian penal Court against her and her parents (if it is an arranged marriage)

Sir if you have any proof to show that your wife was already married at the time of your marriage then you have enough reason to file divorce petition. Along with divorce file an application for interim relief. You can ask court to order your wife to stay at her parents house as the interim relief. As per law, your marriage is not valid if your wife is not divorced. So it should not take much time for separation.
