Can my wife file DV case now or is it time barred

Wife deserted 1 year 6 months back.....(i.e. April 2015) I filled divorce case i December 2015, She filled 498A in February 2016.... Now whether she could file DVC or time barred.?
If she filed case under DV Act, contest it because only after filing divorce case she files DV act.
You can take the contention that only after filing Divorce cse this case is filed. After receipt of the summons you can challenge it in the high court.

Yes she can file dva as it is a continuous offence and can be filed showing same and indicating so , however there is no time bar hence offenec cam be register , but yes if you follow certain strategy you may protect your self from such ...you may consult our office : OFC : Adv Pankaj Kumar & associate....
