Can my father claim his share from his family's ancestral property

Sir we are related mangalore bunts family. we are staying in fathers family inherited property since 50 years. some some of the family members are objecting to any kind of agricultural activity in the land. And others members are list interested to divide the property. So we are in confusion what to do in this situation, how to get land to agriculture or other agriculture activity. . So our question is do we have write to claim my fathers share in the property.

Dear Sir/Madam,

firstly since it is ancestral property you get your share of the property in accordance with the Hindu law. with your share of the property you can carry on the agricultural activities. and to get your share in the property and to partition it you can file a suit for partition.

Yes u can file a case for partition and separate possession and claim your share, further u can take an injunction order not to disturb u from carrying on the agricultural activities in the said lands. Good day

Yes , he can claim his share in the share of the father in the ancestral property. For that your father will have to file a suit for partition and separate possession. Definitely your father will get his share. If your father is not ready for that you can also file a suit for partition and seperate possession in the share of your father in the ancestral property.
