Can mutual consent divorce petition draft have prayer section in it

29-Jun-2023 (In Family Law)
I and my wife are about to apply for MC divorce petition. The legal procedure is being done by my wife's lawyer. All terms is already settled between us and I am supposed to handover DD of a certain amount to her on day on the date of dissolution. The petition draft sent by the advocate for my review has below sentence in "Prayer" section. "...And such other equitable reliefs as deems fit and proper be also awarded. " Please advise me if I need to be concerned about it, when court has nothing to order now?

Dear Client,

This is not of major concern. But when the deal is finalised, why to keep it open end and have vague clauses in prayer.

You can tell your lawyer to remove that sentence. and write a clear sentence "that no rights and liabilities remain on either of party(ies) apart from what ever is agreed in the present consent terms"

Hi,
There is no need to worry. The said line is standard procedure. It's become more like a subscript type format when prayers are put into any petition of any kind. There is no need to be alarmed or cautious because of the said line.

U do need to concern about it as your prayer should be the marriage be dissolved as per the mutual concern term decree be drawn accordingly .ur consent term should consist that the wife here after waive her present future rights of maitainance in liye of the permanent alimony agreed and paid by husband here with.
