Can I take legal custody of my son if my husband is not supportive

can i take legal action against husband who is ignoring video game addicted and sociophobic son and providing him with all kind of comfort inspite of my opposition ?he is ignoring him eventhough he stays all day long inside the room, doesnot go out at all.i could not take him out as son may comeout only for outdoor play that too he doesnot like to play with me as i am a poor sports woman.

Hello Madam, You can take action on your husband for his negligence. You can seek the court for the custody of your son, but only when you're staying alone. when you both stay at the same house and seeking custody doesn't make sense. Filing such custody petition against your husband will have its own consequences and you need to aware of it.

Yes you can file a petition before the appropriate court under guardians and wards act seeking custody of your son. Be that it may be, practically it is not possible to file the above petition when both you and your husband are residing under the same roof, though such things are possible legally.
