my son and his wife and disowned me after my husbands death. it has been 2 years that i have been living separately from them. he does not bother to take care of me. i get my husbands pension which is just enough to take care of my needs. my son does what his wife's tells him to do. he does not take my calls nor does he come to visit me. can i take any legal action against him
You should file a maintenance petition under section 125 of crpc asking your son to maintain you.
He is legally duty bound as well as morally bound to maintain you in case you cannot maintain yourself.
Feel free to contact.
Yes, you can take action against your son under the law of maintenance. We can file an application for maintenance and through that application we can ask the Court to pass a relevant order against your son directing him to maintain you monetarily as well as otherwise.
Regards.
