Can I stay in matrimonial house even after my husband has shifted ?

28-Nov-2023 (In Family Law)
Hello Sir We got married in the year 2010.Presently we have a girl child of 6.5 years old...From the day of marriage I have faced a lot of problems for which we had sitting with elderly persons in Oct 2011 and with lawyer Nov 2014.After the sittings for those 2years it was going nice.. Again we are facing problems after that. Now recently my mil lodged false complaint in police thane and we were called for counselling at mahila thana.Nothing was finalised in mahila PS as we were telling that we will stay in the same house with my in-laws and husband but my in laws are asking to leave the house and stay separately in the small one bedroom for which I am not ready.I also wanted to tell the reason why I am not ready...my FIL and my husband are tax practioners and have a centralisation kalyana mandap. They work together all the day.. Ours is very big duplex house.. We own small 9 houses back side our house.. Now they want us to shift their.. My husband listens to whatever they say...Even if

You have not mentioned whether your in laws are forced you only with your daughter to shift into another house or along with your husband
They can't force you to shift another house.
If your mother in law would torture you more you can take legal action against her as per law after consulting with a lawyer.

You can claim right of residence in the same building by filing a complain in PWDV Act at the office of protection officer. You have to stick to the complain till the DVcase is disposed of.Dis cuss with lawyer for the procedure.

Please inform me whether the house you are staying is owned by your mother in law in her name or it is ancestral property. Your in laws can through you out forcefully , if they use force to evict you then take shelter of law
