Can I marry a girl who has had a void marriage

22-Apr-2024 (In Family Law)
As Hindus, we're considering marriage, but there are some complexities. The girl I want to marry is a distant relative (fourth degree) and had a void marriage with another boy who is now legally married to another woman and has a child. The situation is that she loves both me and him, while I love her. Given that we are all adults, can I marry her?

Hello,

So the first marriage has to be declared to be void by a Learned Judge. Only after that you can marry her. As you are aware you cannot marry someone who is already married thus a Decree of Divorce or Nullity is required for her to re-marry.
