Can I evict my mother from the house gifted to me by my father?

02-Mar-2024 (In Family Law)
My father had gifted me the house 5 years back that me and my mother are currently living in. My father passed away two years back. After that, my mother has put partition case on the same house and put false criminal and DV cases against me to harass me. She is a horrible toxic person and I don't want her to live with me. Is it possible to evict her? Please know that my previous lawyer made me file an affidavit that she can live with me till the partition case is over saying that it will help.

Dear Sir, It is your house and partition suit is not maintainable as Gift Deed was executed by your father who was sole owner of that property. You may file eviction suit against your mother since she is in permissive possession. If you want you can sell that property or lease out the said property and ask the purchaser to get vacate your mother summarily.
