27-Jun-2023 (In Family Law)
I am a single mother. divorced since 3 yrs, My husband is a consultant for a software company. I have not claimed any maintanence for me or my 7 yr old daughter since my separation. Owing to family consent I want to claim for my daughters maintanence. what are the options available. can I claim for a one time payment instead of monthly expenditure? I am concerned since he is settling in abroad shortly and may not turn up later.
Yes madam, you can claim maintenance for your daughter and yourself by filing Cril.Misc under section 125 of CrPC. If you want one time settlement, the Matter need to be refers to mediation. After discussion between you and your ex-husband, if he agrees then matter ends, otherwise, the matter will proceeds. Ultimate decision in the hands of Hon'ble Court.
