Can I be removed from family property after signing NOC

My father constructed a property and died after 1 year of being it established so i and our brother signed an NOC and transferred it to our mothers name. Now my elder brother and mother want to throw me out of the house. What can i do.

Can you please let us know where you have signed NOC? If it was for the development authorities for Mutation, you can challenge the same. Additional information is needed to provide more detailed response.

You have not mentioned what kind of NOC u have signed, anways u r free to file a suit for partition in the property.

Seek an injunction from the appropriate District Court since you have a coparcenary right in this property which was a self acquired property of your father. Therefore, either you may simply file an injunction suit or a suit for partition wherein as an interim measure you may seek protection against your possession from the Court.

Though u have lost your property rights but still you can live in that house. If they are trying to pushed you out of the house then you can file injunction suit against your family . further they create trouble then complaint at local police station
