Hi here RCR order not complyed and wife deserted husband for more than 2 years...and after RCR order wife filed DV and sec 125 case.....and both DV and 125 case are pending in honourable court now can husband file for divorce at this stage under sec 10 of indian divorce act 1869...
As per Indian divorce Amendment Act 2001, you have right to file the divorce if your wife failed to comply with a decree for RCR for a period of two years or upwards after the passing of decree against your wife.
