Broken Decided/Finalised Marriage
29-Apr-2025 (In Family Law)
I was engaged with one girl 4 years back and later her father himself decided to broke marriage due to their Ego and other issues. There was no contact with girl and me because of CORONA. Now after 4 years they are calling us and demanding and threating me to give expenses of Engagement and Gold Chain they had given me in Engagement. We had also gave some GOLD Necklace and Ring to Girl. pls advice what Girl's father have rights now after 4 years. His purpose basically is only to harass me.
don't revert back or talk with them. legally they can use or file police complaint for breach of promise of marriage. so u be prepare with proof that they broke the engagement. and usually whatever is given by both side is exchanged. they might be frustrated as they might have broken the engagement and now they might not be getting any good match
Mutual Exchange: Since you mention both sides exchanged gifts (you gave a necklace and ring, they gave a chain), courts often consider this a mutual exchange. If you return their gifts, you may also be entitled to demand the return of the gifts you gave.
• Time Limitation: Most jurisdictions have a statute of limitations for civil claims (e.g., 3–7 years, depending on the country). After 4 years, the girl’s father’s ability to legally demand repayment or return of gifts may be limited, but this depends on your local laws
As per Indian law, there is no legal obligation to return engagement expenses or gifts after such a long gap, especially when the engagement was broken due to the girl's family’s decision. Since the breakup happened 4 years ago and there was no contact, any claim now appears to be baseless and time-barred. You can inform them that the demand is unjustified and may amount to harassment. If they continue to threaten you, consider filing a police complaint for mental harassment or sending a legal notice through a lawyer.
