Boys father now agreeing for marriage and threatening to file case

15-Oct-2023 (In Family Law)
We both are 26 years old and tried to convince at our homes to get married. I belong to BC and the guy belongs to ST. My parents had agreed but the guy's father is not agreeing and he is warning us that if we marry then he would file an SC/ST atrocities case againt us and get his son married to another girl of their caste. Now after these warnings my parents are afraid as everybody in my whole family are govt. job holders and they don't want to get involved in all these cases. The guy is ready to write a letter saying that he is willing to marry and nobody had forced him to do so. But will that letter be valid? Everybody in my family are scared about my future because of his father. How could we proceed?

for this you need to consult with an advocate personally and you need to tell all the story whatever so far happened and base on that you can take any further step and this is for your and family protection so better to meet with an advocate in person.

it is not a problem, even the parents are not agreed perform the marriage, if both are majors you may perform the marriage with police protection by referring the court at Registrar of Marriages., through legal assistance.

Hi Given that the boy's father is threatening to file false cases against you and your family member, the options available to you are a) Issue notice of marriage at Sub-Registrar office. b) Once notice is issued, you can always claim that false sc/st cases are foisted only after issue of notice. The letter from the boy should be good enough to protect you and your family

Madam, As your boyfriend is also ready for marriage, get married in a temple or Arya Samaj mandir and obtain a certificate of marriage and get the same registered with registrar of marriages. If the father of your boyfriend is threatening you of physical assault or filing of criminal cases, file a complaint with the local police along with the certificate of marriage. The police are duty bound to protect your life and liberty. If the police don't help you, file a petition in High Court and seek police protection to you, your family and your boyfriend. Hope this helps.
