Blackmailing for money saying brother is impotent how to proceed now

26-Sep-2023 (In Family Law)
My brother married 3 years back. My family helped my brother’s wife family by clearing their debts by giving 4,70000 as a debt for 1.5% interest. As we are three sons my elder brother is blind so he is unemployed, got married and also got kids. In order to maintain his family my father gave this huge amount to my 2nd brother’s family. Recently my 2nd brother and his wife went for some tests as they don’t have any children. It was found that my brother had got zero sperm count and some problem with his testes but he is taking the treatment. Taking it as advantage his wife and her family thought of dragging some more money from us. My brother's wife filed a complaint against my parents and him under 498a. Their parents and other political leaders are blackmailing for money if we won't give they shall register FIR. And also saying that we are asking money because your brother is impotent. They are spreading this false news that he is impotent he is not man.

HI,
Their will be no arrest without issuance of 41 (a) Notice to your family by the registering authority asking explanations before registering a case U/s498 A so no need to worry on that aspect . Secondly if she is spreading the rumors then she can take it as an reason for filing divorce in future. As already your brother is taking medicines for the cure then no need to fear for that also . Hope you have promissory note or cheques against the money which is given to them. Do not give any money to them or middlemen. Let them file 498A case, there is no automatic arrest for your brother and family members. Police will investigate and then take action. Your brother can file divorce based on medical records of impotency. It takes some time to get divorce. If possible record all these conversations for future reference.
