Bank transfer by FIL before marriage using it as evidence in FIR
11-Oct-2023 (In Family Law)
Hello there, I got engaged in Feb and married in April 2016. My FIL transferred some X amount to my dad and my account for domestic expenses and jewelry and cloth purchase. We have all the bills of her jewelry and cloths that we had given to her at marriage. Now that she left my parental home in june she left with all her jewelry and cloths. I am suspecting 498a. We did not demanded any money but its her father who offered money to buy her jewelry and cloths as we expressed inability to buy that amount of jewelry. We have all the bills. The amount was transferred after engagement and 1 month before marriage. We never harassed her after marriage although she can allege. But she wont have any proof. We have sent her a letter with registered post that whatever amount they have given for the girl we have returned the same and she can come to take care of her left belongings. I just want to understand the best possible ways to prepare beforehand so that she never get any upperhand after FIR
Make a complaint to police for mental harrassment and cruelty to you and your family. Looking at the merits of the case you can also file petition for restitution of conjugal rights. Amoutnt of money transferred by your FIL will define whether the amount transferred was for petty expenses or it was a handsome amount amounting to chargefor dowry demand.
Sir definitely she can file a case under 498 ipc.. The precaution that you can take now is that you can file anitcipatory bail .. Generally you will be called for investigation when she will file a complaint in women cell.. After investigation the police may register an fir.. In such cases the sympathy is with the wife and case do get registerd..
Hi,
keep all the evidences with you and never return any amount or things belongs to her without any proof of handover and always ask to return at home and make the evidences of your favour...
Thanks & Regards
