Assault by brother in law, damage to property and defamation

12-Jun-2023 (In Family Law)
Two months ago my wife (living separately for 4 months) and uncle wanted to come to our place to collect her belongings but when she arrived with her uncle, her two brothers came along and entered house without permission. Only me and my elderly mother were at home. After collecting belongings her brothers became abusive and started assaulting me. They were shouting loudly so that our neighbors would hear it and broke a few things in our property. Despite the complaint no FIR yet kindly advice.

If the police officials are not listening to register a FIR against the culprits then you have the option to approach the magistrate according to your jurisdiction and file an application under section 156(3) for registration of FIR under section 323/452 IPC. Since house trespass under 452 is a non-bailable offence then they will land themselves in jail soon. For more legal assistance I am just a call away.

It is quite apparent that you have your neighbours as eye witnesses for the offence committed by the perpetrators. Since the police is not lodging an FIR, we should file a petition under Section 156(3) Cr.P.C. for directions to be given by the court to the SHO of your concerned police station to lodge the FIR against them and arrest the perpetrators for committing cognisable offences.
