Asking In Laws to Remove Furnitures

23-Aug-2023 (In Family Law)
Sir/Madam, my wife is not residing with me due to various issues. It is more than one year we are staying separated but legally not divorced. Her furniture are kept in our house which she is not taking back. She is not willing to keep any further contact with me. In this case, how can I remove her furniture from our house? Should I send her any letter to arrange removing all these or is there any separate law for this, please suggest from legal point.

certainly we lawyers give all suggestion from legal perspective. notwithstanding anything since the marriage is subsisting so the house is her matrimonial house in which she has a right to keep her belongings. if you want to remove them you can only do that with her consent not otherwise. writing letters asking her to arrange removal would be an exercise in futility. I'm sure my other brother and sister colleagues here have already given you this note of caution. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi University), Advocate, Hon'ble High Court, Calcutta
