Agreement for living together - marriage

28-May-2024 (In Family Law)
We are living separately from last 1.5 years. Now my husband is saying, I want a return agreement from you that you will not file any case against me than only I’ll live with you. Is it legal and valid?

Agreement is always Mutual. If the issue can be mediated then both the sides will be heard and mutual settlement can be framed on mutually agreed terms and conditions. For further guidance need to explore the case in bit more detail.

Well, that agreement even if you sign will not be valid in the eyes of law, considering, if he tries to violate laws and in pursuance of such, he commits any offence against you, then, in such a process, obviously, you will file a case against him and during such time, no sue clause agreement will not help him. If he wants to start living with you, tell him to leave peacfully and lovingly, he must care for you, respect you and in vice versa, he will get care and respect
