Actions for compromise against the 498 A

1. Can we force other party to go for mediation process and complete the process ? 2. Do we need to give response for 498a complaint file against us in CAW cell ? 3. What we should do in case if we want to take her back to our home provided she agrees that she has made false allegations against us in her 498a complaint filed in CAW cell?

With regard to your first query you cannot force the other party to go for mediation.
Secondly there is no provision under the law to file an reply for complaint under section 498 A IPC. But if you want , you can file reply to put your defence in written.
Thirdly you can file a case for restitution of conjugal rights under section 9 of Hindu marriage act to bring her back.

You cannot force anyone for mediation. It is like an agreement to settle the matter with consensus.
You should reply/ respond to the complaint which she had filed in CAW otherwise police will register an FIR against you and your family member and at that time you will not get a chance to put forward your defence. You have to fight with her in each forum. The only you can succeed in bringing her back in a matrimonial home . Revert me . All the best.

We cannot force we can request n almost all matrimonial dispute are settled
2. You have to attend proceedings in CAW cell otherwise non appearance can lead to FIR registration.
3. Settle matter make MOU n get signed terms n conditions shold be clear....n also get statement recorded in CAW cell

is the case pending in court or running the case in any court if not or if the case is in first stage at women cell then the women cell callled to both parties for compromise at many time, minimum two times before file the FIR. You can not give the pressure for compromise only request.

If things are getting resolved then a compromise can be written in CAW Cell therefore you can get it forwarded to mediation and a compromise can be written there.You need not necessarily reply to the CAW cell proceedings ,As you said if she wants to go home then not a bad idea to settle out things.
