Visitation Rights Under Section 21 D. V Act
13-Mar-2023 (In Domestic Violence Law)
DV filed in the Court. Judge ordered Visitation Rights without any application of accused since one day accused had gone to complainant's home and threatened, abused the whole family. Now complainant was supposed to go to child Complex of the court on 1 saturday in a month as per the order but we were not aware of the order, we got to know today through our lawyer. Now we have missed 3 Saturdays in a row of the visit schedule. But we are going the next Saturday for visitation. Now what will be the consequences of not following the visitation order which we didn't violate intentionally. What can we say to judge?
ignorance of law or a lawful order of a court is not a excuse. Hiw you were not aware of the visitation right order of the defendant is surprising it can only happen when you fo not attend or not give attention on court proceedings and its daily orders. Not obeying court orders can effect your case as well as attitude of your case MM . See father's visitation right can not be denied by any court provided there is no direct threat to life or danger of assult on the child.
please engage a good and experienced advocate in your case so that you can not miss any court order and your case can be looked after well.
