Threatening by Daughter in Law while matter under sub judice

04-Aug-2023 (In Domestic Violence Law)
My daughter in law left my residence at her own wish while having 5 months of pregnancy. She aborted the child at her parent's place and after three months of the incident filed a case on me, my husband, my son, my daughter, and my sister under 313 and 498A. We are struggling with the burden of the case since 2017 and during these years she and her family has become rich by getting into a prostitution business. Moreover, she is a habitual domestic violence woman and formerly married with two persons and left them after harassing them with 498A and charging lump sum money. Charge sheet filed by the investigation officer, who was also her customer, so it's against us. The matter is under sub judice and trial not yet started. But, now she is calling my son and threatening that she can come back anytime and stay in our house. Please suggest how to handle the situation.

First of all, let me know who is the owner of the property where you reside. If your son is the owner then he have to transfer it to any other person. If your husband is the owner then I suggest you to file a Suit for Declaration and Permanent Injunction against her and also pray for temporary injunction before the civil judge. If the temporary injunction will grant in your favour then she can't enter in your place according to the order.

You need to file a formal complaint against your daughter-in-law. Further, you need to file an application before the Hon'ble High Court for quashing the complaint filed by your wife. You also need to file a suit praying for injunction against her coming back to your house.
