I had filed dv case and on insistence of husband resumed his home. He continued his violence thereby i left his home. Now the case is at interim stage but all this is so stressful it is causing me mental distress. I wish to withdraw the case and stay separated from husband. He is not willing to give divorce although I'm asking him no money. He ia deliberately doing this to cause pain to me. Is it ok to withdraw the case at this stage? 2.What say shall I put forward to support my decision to withdraw. 3. If it is not right to withdraw how to proceed further in this matter.

You can file a contested divorce case against him, and your dv case u can use there stating that he has been harassing you. At present you should not withdraw it. It is always betrer to file consent term instead of withdrawing a case.

you can bring the aforesaid facts of mental distress caused to you by your husband on record before the court. once the same are before the court of law, then pray that your husband be barred from doing such things.. it would be taken otherwise by the court if at this stage you withdraw the case..this may turn in your favour or may not..
