Fake Domestic Violence Case - Hindu Marriage
23-May-2023 (In Domestic Violence Law)
My partner unjustly accused me of domestic violence and lodged a complaint with the police station. After a period of 65 days, she now desires the retrieval of her possessions and has asked the landlord of the rented apartment to draft a rental agreement in her name. I already have a rental agreement in my name. What are the proper legal procedures to return her belongings? I genuinely want to reunite her with her possessions.
If you wish to reunite with her and she’s not in her matrimonial home then it’s advisable for you to file a petition under section 9 Hindu Marriage Act to bring back her. You need to file it before your partner gets to the court and file fake DV or maintenance cases against you. For more legal assistance I am just a call away.
In case a Complaint is filed before the CAW Cell they act like Mediators before the Complaint is transitioned into an FIR.
Secondly, you may draw a Memorandum of Understanding between you and your partner for exchange of belongings.
Are you still residing with her? You are not obliged to to change the Rental Agreement in any case.
