Domestic violence from my wife.

08-Jan-2023 (In Domestic Violence Law)
I was married on 21.02.2019 Some awkward situations occurred on 26.02.2019 only due to some abnormal (mental) activities from my wife. Afterward her parents took her back to her parental house on 09.04.2019. After my many repeated requests they did not told me the exact reason that why she did so. Also they are not telling me about any medical treatment of her. She is still living there. I helplessly have filed complaint against my wife in Commissioner office. They forwarded it to woman cell and they called both the parties there. I went there many times but my wife is not coming there for giving her the statement only her father came and gave police the statement. I don't know what he told in his statement but now complaint is just as it is held with police they are not taking any action against her and telling me that they cannot forcefully call the girl to police station as it is her right. Girl's parents are demanding money from me indirectly. What should I do .

Hi, Thanks for your query! Domestic violence act specifically applies only on aggrieved woman. Means it gives relief to aggrieved wife only not to aggrieved husband. As you wrote, she has some mental illness which she and her family hid from you. Let us know, what kind of symptoms she had? As the wife is in his maayka, You could lots of things but it all depends on the current facts and what you exactly want. You are requested to please consult personally for specific legal advice as per your case. Thanks!

Dear queriest, you can file a case for restitution of conjugal rights and further you can claim for damages and mental harrasment you are facing at the hands of your wife and inlaws. Police cannot take any action and no fir can be register against your wife but only criminal complaint before the competent court can be filed.
