deny maintenance on desertion and cruelty grounds
22-Feb-2023 (In Domestic Violence Law)
Wife filed cases under u/s 498a and 125 crpc. In year 2005, No child I am paying 10k pm as interim.
I won Divorce case on grounds of Cruelty at the hands of wife, (written evidence by wife that she was a liar, and mostly stayed at her parental home, and was forcing to stay away from matrimonial home)
We (myself, mother and brother) got acquittal from 498A, 406, 304 cases on the grounds of desertion and cruelty (evidence was her written apology and mobile conversation wherein she admitted that she had filed a false case of 498a).
What relief I can have in 125 and what sections can be used. Shall I continue paying maintenance u/s 125.
I am jobless now.
If you are not capable to pay the maintenance then you can file your maintenance against your wife as the worst thing that you are jobless now and for that we need to see your documents in order that has been already disposed of or staying then will only discuss about the facts which can be taken against the same
