Wife did not produce passport of daughter for visa what can I do

Daughter's passport(2 yrs) is handed over to wife for a visa process, husband pays the visa fee and expects that wife will produce daughter's passport to visa processing authorities when expected to do so. The wife does not produce the passport when required and the visa fee paid to the consulate is lost by her such act. The daughter's passport is in custody of wife and wife is leaving separately. The passport was given while the relations were good but later wife started living separately .Who is the legal custodian of daughter's passport(husband or wife) Is this cheating or breach of trust
Dear friend as per your question and acording to law hindu minorty and guardianship act 1956 section 6 mother is natural guardian then father is natural guardian after ataind 6 yrs so now your wife is natural guardian of your child but when you file a application custdy of child before family court court find welfare of child
