What is the procedure for changing of name in the joint business firm

27-Sep-2023 (In Documentation Law)
We've a joint business and there's a firm which my uncle is handling for the last few years but is in the name of my mother, so now they want us to pay all the debts relating to that firm despite the fact that we were not taking the profits from that firm. What should we do in this situation?

Your mother can file an FIR or a private complaint in the court for criminal breach of trust under section 405 of IPC on your uncle stating that your mother agreed to give her name to the business on the basis of trust. She should also write a notice to the ROC to take cognizance.
