What is procedure for Court Marriage under Hindu Law

23-Jul-2023 (In Documentation Law)
I, a woman of 25 years old want to marry a guy of 23 years old. We both are Hindu but I am from Kolkata, West Bengal whereas he is from Madhupur, Jharkhand. Our communites being different, both of our parents as well as family are not accepting our marriage. So we want to do legal marriage through registration by the court without informing our family. Can we do the same? How? And another thing I fear of is being unable to arrange witnesses, as neither parents nor any relative has consent to our marriage. Besides we have very few friends who will be taking interest in being our marriage witness. So please show me some hassle-free legal marriage procedure.

The process is extremely easy, if you note that both of you are hindus so you can get married as per Hindu Marriage Act, Section 7 (2) states that taking saptapadi, i.e. the 7 rounds , the moment it is complete the marriage is done and complete and both of you become husband and wife. As you state you have friends by your side, ask them to click pictures of the 7 rounds before the fire, both of you in garlands and sindur, if possible a full video recording by a professional video recording person be done, keep CD's, back up copy over email of the video and ample amount of pictures of your marriage. After completion of 7 rounds, apply for registration under Hindu Marriage Act, 1955; wherein you both need to provide a joint picture of your marriage done in garlands and sindur, address proof's, and such marriage will be registered within 7 working days, for witnesses keep 3 friends ready or any brother sisters who are on your side. As you stay in kolkata, any one parties address proof is enough to complete registration. If any further queries kindly connect.

Go to the office of Marriage registrar who has been authorised by the Government for registering the marriage under Hindu Marriage act as well Special Marriage act and they will guide you the formalities to be made out for getting the registration done. As 1 month notice is mandatory for getting the registration done.
