What can be a substitute for Legal heir ceetificate

Sir my father was a mental retired person and was a govt servant . He is being missing from the last 22 months and couldn't be traced. In May 2018 his service tenure was fully covered. Our mother died since we were in schools. We are three brothers and no sister . Can we withdraw the EPF-GPF money ? When asked in the office they told us to produce legal heir certificate which is not possible to produce. Do there any other substitute so that we can legally withdraw that money?

You cannot obtain legal heir certificate as you cannot obtain death certificate because your father is not dead. Well in such cases, you need to obtain succession certificate so as to establish urselves as the successors-in-interest.

According to law a person missing for continuous 7 years and not found and seen inspite of best efforts to search,is deemed to be dead.U must have proof of his missing.intimation to police etc.After 7 years u move to Court to get death certificate.
