Ways to recover the documents from relative who is denying it

Our family property document has been given to my father's sister to get some amount.My father and his three brothers are legal heirs.One of his brother is not able to repay the amount where other three are ready to settle the amount.In this case,we want to know what has been written in the document to divide the property.My Aunty refuse to give the document.How to get the document? Let me know the possibilities plz, we are Hindu.

Is the document registered?? If yes, you can obtain a certified copy of the same from the concerned Sub Registrar Office, if no you can send a notice to her to produce the original document, even after receipt of the notice if she fails to provide the documents, you must file a suit against her to produce the document

First you need to find out whether your father has created any charge over the concern property. You need to verify it from the concern sub registrar of assurance on paying the requisite fee, by obtaining certified copies from that office. once you are sure that there is no charge or mortgage by way of deposit of title deed than you may proceed with the next course of action on the issue. KIndly get proper advice from a property/civil lawyer in this regard to proceed further by explaining the detail facts of your case.

You must file an inter-pleader suit in the court, and seek recovery of documents. You must be ready to deposit the amount in the court when needed. You will get back the title documents.
