Draft Franchisee agreement , Is stamp duty necessary for sign franchisee agreement . can we do agreement by email.

Stamp duty is mandatory to be paid before signing of the agreement at the rate as is applicable under the provisions of the respective state laws. If the parties are based in different states than you have to pay the stamp duty at the rate that is higher of the respective states. It is advisable to have a physical copy of the same and be executed, else if you want to execute the same electronically, then the same can be signed by affixing digital signatures of the parties to the agreement.

Dear Querist, Franchisee Agreement need not be compulsorily registered. A Stamp Duty payable on the Franchisee Agreement is Rs 100/-. Yes. But it is advisable always better to agree all the terms through email and sign a conventional document affixing signatures and stamps( if any).
