Procedure to change name in documents without advertising it

11-Oct-2023 (In Documentation Law)
I have changed my surname after marriage. I am Hindu. My marriage was registered according to Hindu Marriage Act. At the time of registration, I took legal opinion on changing my surname. I was informed by my legal counsel that I need to submit an affidavit regarding the same to SDM office, Rampura, Delhi and I do not need to publish the same in newspaper as it is a regular practice that girls opt the new surname. The same was confirmed by the SDM office. Now, for changing the name in my office profile, they are asking me to show the law stating the same or to provide them the copy of advertisement in the newspaper. I want to know which law supports this and what is the exact procedure for this?

Kindly confirm, have you also got marriage registration certificate from your sdm, area office. It is mandatory to register a marriage as per Section 5 of Hindu marriage act 1955 and after registration you will get Form B or Marriage certificate.
General charges are 8000-10000 for this process.

From your above query it seems firstly after your marriage only surname was changed and secondly your marriage was duly registered as well. Hence , duly issued certificate is the sufficient prove to establish your requirement unless someone challenges the validity of the same. Only in those cases where complete identity of the person like name change etc. ( contrary to your Board certificates etc.) we need to go through the complete court process. If needed, we can do specific research based upon your documents.
