Not getting baby's birth certificate

13-Jan-2023 (In Documentation Law)
I got married almost a year ago. Now I have birth to a baby but Navi Mumbai municipality corporation is not issuing birth certificate because in my adhaar card my maiden name is mentioned. I have not changed my surname after marriage and don't wish to change as I have to then change surname in each and every govt docs. Is there any rule in Maharashtra that I have to change surname then only birth certificate of baby will be obtained. Marriage certificate is there but still they are not accepting.

1)Demand of Municipal Corporation is illegal there is no such legal rule.

2)Therefore you can ask them to give reason in writing.

3)You can complain to their higher authorities.

4) You can told him I am ready to file affidavit regarding names of your are same.

In the State of Maharashtra the convention has been something like a child's name followed by father's name followed by surname. However, recent court decisions allow child's name after mother meaning child's name - mother's name - surname of mother. However, Municipal Corporation or local authorities may be uncomfortable to put father's surname after mother's name. If they continue to relent then you have two choices 1) Change your Aadhar card to a suitable name or 2) Approach court (which may take long time).

Also if you can do this then go to your home state and try getting birth certificate there, if possible, in any name you want.
