Is presence of owner mandatory for Gift deed registration

we have land in thondamuthur. Owner is in usa and would like to gift the residential land as gift/ gift settlement to his brother in law in india. The question is does the owner have to be present in the registrar office or can execute a power of attorney to take sign the gift settlement. 2. Does the u.s. owner has to produce a live certificate in case if the power of attorney is more than 1 month old. Thanks.

Yes it is made mandatory for any sub-registrar to ask for a life certificate if a sale or conveyance done after the period of 30 days of Power Deed given and the agent sign on behalf of the principal. If the owner went to USA after executing the power you may ask the owner to reauthorise through a fresh power deed in USA and get it adjudicated here in India soon after which you can execute the sale.
