21-Jun-2026 (In Documentation Law)
Mu grandfather migrated from andhra to west bengal in 1964 as he got job in railways since then his son I.e my father was also raised here . My father is a retired service man worked in west bengal . Iam 30 years born n raised in west bengal .all our documents belongs to west bengal even my grandfathers as well. We went to andhra to obtain a caste certificate they denied saying " all of your documents belong to west bengal so we can't issue a digital caste certificate instead they issued us a manual migration cum caste certificate in the name of my father " There is a circular from ministry of home affairs and ministry of social justice which clearly says the migrated state may issue a certificate irrespective of whether the cast in question is relevant in the migrated state or not .only central govt benefits can be availed through it . When iam applying for my caste certificate in west bengal they are straightaway denying it . Help me how to tackle it
Dear Client,
Your query lacks information. You neither disclose the ground behind the denial of application for caste certificate by the competent authority of West Bengal nor the name of the caste which is crucial to defend such arbitrary denial. However, be informed that caste of a person is determined by birth and a child gets the caste of his father. The central government and state government maintain separate list of casts eligible for reservation benefits. The state caste certificate is valid only in the domicile state as well as central services and is not valid in other states. A person born in West Bengal can apply for caste certificate from the competent authority of West Bengal attaching an affidavit explaining the reason behind your application for the issue of a caste certificate from West Bengal, but its acceptance solely depends on the decision of the State Level Caste Scrutiny Committee. So, unless the ground behind the rejection of your application for caste certificate by the concerned Authority is known to Counsel, no viable option or steps can be informed upfront. Trust the matter stands understood.
