I want to marry a Bangladeshi girl. What is the procedure for an Indian citizen to marry a Banglades

08-Jul-2024 (In Documentation Law)
I am from Kolkata, West Bengal, and I am planning to marry my girlfriend from Chittagong, Bangladesh, in July 2016 in Kolkata. What procedures should we follow considering she will be visiting India on a one-month travel visa? Which documents do we need to carry for both of us? Additionally, what steps are required for her to obtain Indian citizenship? We are both 26 and 28 years old, employed in our respective countries, and both Hindu. Please advise!

Yes, an Indian boy can legally marry a Bangladeshi girl in India under the Special Marriage Act, 1954. This law allows for civil marriages between individuals of different nationalities, religions, or castes. However, certain conditions must be fulfilled:

  1. Legal stay in India: The Bangladeshi citizen must have valid legal status in India (such as a long-term visa).

  2. Notice period: A 30-day public notice is required at the marriage registrar's office in the district where at least one of the parties has resided for at least 30 days.

  3. No objection: If no objections are raised during the notice period, the marriage can be solemnized.

  4. Citizenship: Marriage does not automatically grant Indian citizenship. The Bangladeshi spouse can apply for citizenship after fulfilling the residency requirement (typically 7 years under Indian law).

It is advisable to consult a legal expert or marriage registrar for the latest documentation and procedural requirements.

Hello, The answer for the query asked by you is as follows: I. The Documents required for registering your marriage in India are : 1. Application form duly signed by Husband and wife 2. Documentary evidence of the date of birth of the parties 3.Two passport size photographs and one marriage photograph 4.Ration card of husband or wife whose area SDM has been approached for the certificate Affidavit by both the parties stating place and date of marriage, date of birth, marital status at the time of marriage and nationality 5.If marriage was solemnized in a religious place, a certificate from the priest is required who solemnized the marriage 6.Affirmation that the parties are not related to each other within the prohibited degree of relationship as per Hindu Marriage Act or Special Marriage Act as the case may be Attested copy of divorce decree/order in case of a divorcee and death certificate of spouse in case of widow/widower 7.All documents excluding receipt should be attested by a Gazetted Officer 8. If one of the parties is a citizen of another country , the registrar may request a “no objection letter”from the Embassy or Consulate of that country, and also may request proof of termination of any previous marriages, before a marriage certificate will be issued. The procedure you need to follow for getting married is that: All the documents duly attested must be carried before the Registrar and Verification of all the documents is carried out on the date of application and a day is fixed and communicated to the parties for registration. On the said day, both parties, along with a Gazetted Officer who attended their marriage, need to be present before the SDM. The marriage certificate under the Hindu Marriage Act is issued on the same day or within a few days. II. The procedure for obtaining citizenship is : After getting married your girlfriend can apply for Indian Citizenship as there is a provision under the Indian Citizenship Act for obtaining citizenship whereby if the spouse is Indian citizen then his spouse being NRI can obtain for Indian Citizen.
