How to Renew the passport as the case is still pending in court

I have 2 cases, 1st case 383 and 503, 2nd 354a and it act 67a i got cash bail of rs 10000 and 2nd case surety bail of rs 15000. Charge sheet is not yet filed. Its been 10 months now after getting bail.I want to renew my passport as it is expiring in April,2018. I want to take my mother for religions tour. 1)If i don't show any court cases in passport application will be good & apply in tatkal. 2)Is there any fine or jail for not disclosing cases and found afterwards.How much fine or jail. 3)Should i disclose it in passport form first chances for rejection of passport application. 5)If court rejects the application what to do. 4)Please suggest what to do.

Good Afternoon! First your bail bond must be checked if it stops your moving out of the country/ free movement. You cannot conceal your court cases as it is against the Passport Act. Incase you think of doing any such thing, another criminal proceeding will initiate against you and your current bail might get cancelled as well. If your court rejects the application then you can file a writ in the High Court directing the lower court to admit the application.

Firstly if u don't disclose about the pending cases there is a penalty of RS. 5000 under section 12(1) of the passport act. That means u will have to mention about this.

So with regards to procedure
Firstly you will have to take permission form respective court where your cases are pending which generally court grants and then apply for renwal and for visa.
