How to get transfer of property ownership title to wife

10-Dec-2023 (In Documentation Law)
My father died in an accident 2 yrs back. We need to transfer his property in the name of my mother. Does the transfer procedure is same as that of purchase by third party like paying stamp value of property etc or else are there any other legal proceedings to transfer the title. How much shall these process cost on an average and how long the process shall take to complete.

Hello,

The Property cannot be transferred by way to sale and purchase since your father is a deceased now. You will have to apply for heirship i.e. Succession Certificate. This is done via filing application in Court, you need to approach a Advocate in your nearby area for the same, he will help you get it done easily. The payment varies from 30k to 50k and the duration is 3months to 6 months as the case may be.

firstly did your father execute any will. if the said property is in a society , their has to be a nomination form for the same. if not their all the legal heirs of your father have equal right in the property. further for understanding the fees structure and expense you need to get in contact.
