How to get my father's death certificate who is missing from 17 years?

My father had left my family when i was 5 years old... I'm 22 years old now...its been almost 17 years now...my mother is uneducated and financially not Strong...so she was not able to register a complaint in police station about this or to try finding him...but everyone in our family know about this incident... his whereabouts are unknown for 17 years now...how can i get his death certificate now...? Because of our Future needs we are willing to get possession of our properties from his name to my mother's name...what are the possibilities that i can get it done.??

A person missing or absconding or not be known of his whereabouts for more than 7 years continuously is deemed to be dead in our law. But that has to be declared by the jurisdictional Civil Court. It would have been good if you had lodged a police complaint to prove the lapse of over 7 years till date. Anyways, since you have other eye witnesses, please file a Declaration case in the Civil Court and first get your father declared dead and after that the natural laws of succession applies wherein you and your mother will be equally entitled to inherit if the father's property is his self acquired property.

Now file a complaint naratting facts what happened take paper publication in national newspaper later approach now availibility certificate from concerned corporation, municipal, gram panchayat later file case and obtain certificate direction from court

File your report with the Births n deaths registrar
He may conduct inquiry
Then give evidence of your mother and elderly close relatives to the effect that your father's wherabouts are not known for over 17 years
Then registrar may issue the death certificate after recording the fact of presumed death of your father
