Father's Shares in D-mat a/c want to transfer share in mother's name

My father having shares in D-mat a/c and nominee details were not mentioned and now he is no more. We want these shares to transfer on my mothers name. Please advise us what are the steps has to be taken.

After the death of your father your other along with other children I.e you as well as your other brother/s and sister/s inherit his property including these shares in equal share.
Who so ever wants to transfer the movable property left behind by your father in his/her name has to file an application for grant of succession certificate before a court of competent jurisdiction with no objection in his favour by other legal heirs . Here you and your brother sisters have to give NO OBJECTIONS and the company whose share your father has,has to beade a party.After grant of Succession Certificate the shares will be transferred.

There is a difference between transfer and nomination. Nomination only entitles the nominee to enjoy the benefits, the nominee does not become the owner. If your father has left a will behind, you have to see who your father has left these shares too and if its in your mother's share then you have to obtain a probate and thereafter ask the company to transfer. If your father has not left a will behind, you have to apply for letter of administration and seek from the court a decree to divide your father's estate and then these shares can be transferred to your mother.
