21-Dec-2023 (In Divorce Law)
My brother and his wife are fighting a legal battle for divorce since last 5 years. They are in Kolkata and I am based out of Pune. Will my witness be considered relevant on the basis of what I heard over the phone while conversation between me and my father happened. My father passed away last year.

yes your witness will be very important for that you need to prepare, its not that easy, any person getting into witness box gets a mind block, looses confidence and forgets everything, the person feels is he or she a criminal it needs proper planning

yes you can say your advocate to consider you as a witness and can represent your self in court and say your opinion or points on what you heard or show as per according... you can narrate the conversation in court...

as a thumb rule hearsay evidence is excluded unless they are occasioned by certain circumstances. in your case prima facie it appears your evidence if it can pass the constrains of inadmissibility of hearsay evidence by making the conversation contemporaneous with the events narrated over phone then it could be of some relevance but its better to presume that your evidence will be a very weak piece of evidence.
